Maryland State Board of Contract Appeals Disallows Late Filed Protest

The Maryland Board of Contract Appeals issued a new opinion in February, which can be found here. The gist of the ruling can be succinctly stated as follows:

•           If the regulations and invitation for bid require a protest to be filed in seven days, don’t file the protest on the eighth day.

The Board noted that filing via e-mail was not permitted, intermediate Sundays are included in computing the deadline, and that the “7-day filing requirement is imposed by law, and it cannot be waived by a State agency.”  Pretty much sums it up.
