Pepsi Threatens CrossFit

CrossFit recently reported that PepsiCo sent CrossFit a cease-and-desist letter based on CrossFit’s alleged use of Gatorade’s trademarked logo (Gatorade is owned by Pepsi) in CrossFit’s Hyponatremia of Exercise series. CrossFit countered that its image constitutes fair use, and that its purpose was to educate the public on Gatorade’s alleged hydration myths and not for a commercial purpose.

CrossFit is well-known as being outspoken in its views regarding corporate influence in science and exercise, and has in the past fought to defend its reputation. It will be interesting to see if Pepsi follows through on its legal threats. You can read Pepsi’s cease-and-desist letter in the link above.
